GENERAL AGREEMENT 

By hiring equipment from Ground Up Hire Co., the Hirer agrees to these Terms & Conditions in full. 

The Hirer acknowledges they are responsible for the safe operation, care, transport and return of all hired equipment during the hire period. 

Ground Up Hire Co. operates primarily as a dry hire business unless otherwise agreed in writing.

HIRE PERIOD 

The hire period begins at: 

• the time equipment leaves the yard; or 
• the agreed delivery time

The hire period ends when: 

• equipment is returned and inspected; or 
• collected by Ground Up Hire Co. 

Additional charges apply where equipment is returned late without prior approval. 

Weekend and long-term hire arrangements must be agreed prior to hire commencement.

PAYMENT TERMS 

Full payment and bond may be required before equipment release. 

Hire charges continue until equipment is returned in acceptable condition. 

Outstanding invoices may incur additional recovery costs. 

The Hirer authorises Ground Up Hire Co. to charge reasonable cleaning, repair, fuel or recovery costs where applicable.

SECURITY BOND 

A refundable security bond may be required for all hires. 

Bonds may be withheld partially or fully for: 

• equipment damage; 
• excessive cleaning; 
• fuel replacement; 
• late return; 
• missing items or accessories. 

Bond refunds are processed after inspection and approval.

CUSTOMER RESPONSIBILITIES 

The Hirer agrees to: 

• Operate equipment safely and only for its intended purpose 
• Ensure operators are competent, appropriately licensed and physically capable
• Follow all manufacturer safety instructions
• Not allow unauthorised persons to operate equipment
• Not use equipment:
  • under the influence of drugs or alcohol; 
  • illegally or negligently; 
  • outside manufacturer recommendations. 
• Maintain daily checks including:
  • fluid levels; 
  • visible damage; 
  • tyre/tracks condition; 
  • grease points where applicable. 
• Immediately report:
  • damage; 
  • malfunction; 
  • theft; 
  • incidents or accidents.

EQUIPMENT CONDITION 

Equipment is supplied in working order unless otherwise noted. 

The Hirer must inspect equipment before use. 

Continued use of equipment confirms acceptance of condition. 

Equipment must be returned: 

• clean; 
• fuelled (where applicable); 
• free of concrete, mud, excessive debris or contamination. 

Cleaning fees may apply.

BREAKDOWN & DAMAGE 

The Hirer must stop using equipment immediately if damage or faults occur. 

The Hirer must not attempt major repairs unless authorised by Ground Up Hire Co.

The Hirer is responsible for damage caused by: 

• misuse; 
• negligence; 
• improper transport; 
• operator error;
• operation outside intended use.

Fair wear and tear is accepted.

THEFT & LOSS 

The Hirer is responsible for theft or loss during the hire period. 

Equipment must be secured when not in use.

Theft must be reported immediately to: 

• WA Police; and 
• Ground Up Hire Co. 

The Hirer may be liable for replacement costs not covered by insurance

DELIVERY & COLLECTION  

Delivery and collection services are available by arrangement. 

Ground Up Hire Co. is not responsible for site access issues, delays or unsafe unloading conditions. 

The Hirer accepts responsibility once equipment is unloaded or collected by the Hirer.

LIABILITY 

To the maximum extent permitted by law, Ground Up Hire Co. is not liable for: 

• indirect loss; 
• loss of income;
• property damage;
• consequential damages. 

The Hirer accepts all risks associated with equipment operation. 

Ground Up Hire Co. makes no guarantee regarding suitability for specific task 

INSURANCE 

Ground Up Hire Co. maintains general equipment insurance. 

Insurance exclusions and excesses may apply.

The Hirer remains responsible for neglect or unauthorised use.

TERMINATION OF HIRE 

Ground Up Hire Co. may terminate hire immediately if the: 

• terms are breached; 
• equipment is misused 
• payment is overdue; 
• unsafe operation occurs. 

Ground Up Hire Co. may recover equipment without notice if necessary 

PRIVACY & CCTV 

CCTV may operate at the yard and collection areas

Personal information is used only for: 

• hire administration 
• identification 
• payment processing 
• security purposes

GOVERNING LAW 

These Terms & Conditions are governed by the laws of Western Australia. 

Any disputes shall be handled within Western Australian jurisdiction.

ACCEPTANCE 

By proceeding with the hire, the Hirer confirms that they:

• understand these Terms & Conditions; 
• accept responsibility for the equipment; 
• agree to operate equipment safely and lawfully
